PrivacyPrivacy Policy

This document was last updated March 30, 2011

This Privacy Policy governs the manner in which BrainCredits collects, uses, maintains and discloses information collected from users (each, a "User") of the BrainCredits service ("Service"). This Privacy Policy applies to the Service and all products and services offered by BrainCredits.

Introduction

BrainCredits provides users with an online Transcript to record all of their learning activities. Your Transcript is intended to show interested individuals, including colleagues and potential employers, that you are a continual learner by providing both detail and summary information of the learning activities that you choose to post to your Transcript. In addition to your learning activities and your name, you could choose to add to your Transcript other personal information including your email address, description of your background or skills, and links to your other publicly available third-party user profiles.

Because your Transcript is intended to be shared, by default your Transcript and any entries you post to your Transcript are set up to be displayed publicly on the web via your unique Transcript page. But the amount and type of information you decide to share is up to you, and you can choose to mark individual Transcript entries, or your entire Transcript, as "Private" at any time.

Personal identification information

We may collect personal identification information from Users in a variety of ways, including, but not limited to, when Users visit our Service, when a User registers for our Service, when a User provides the contact information for a prospective user for the purposes of inviting them to the Service, and in connection with other activities, services, features or resources we make available through the Service. If you link your BrainCredits account to another account or service, or use other, third-party sites or services in conjunction with your BrainCredits account, we may collect information related to your use of third party sites and services accessed through BrainCredits or when you access BrainCredits through a third-party site or service.

Users may be asked for, as appropriate, name, email address, and other profile information. Users may, however, visit our Service anonymously. Users can always refuse to supply personally identification information, except that it may prevent them from engaging in certain Service related activities.

Non-personal identification information

We may collect non-personal identification information about Users whenever they interact with the Service. Non-personal identification information may include the browser name, the type of computer and technical information about Users' means of connection to the Service, such as the operating system and the Internet service providers utilized and other similar information.

Web browser cookies

Our Service may use "cookies" to enhance the User experience. A User's web browser places cookies on their hard drive for record-keeping purposes and sometimes to track information about them. A User may choose to set their web browser to refuse cookies, or to alert them when cookies are being sent. If they do so, note that some parts of the Service may not function properly.

How we use collected information

We use the information we collect to analyze how the Service is used, diagnose service or technical problems, maintain security, personalize content, remember information to help you efficiently access your account, monitor aggregate metrics such as total number of visitors, traffic, and demographic patterns, and track Service content and Users as necessary to comply with the Digital Millennium Copyright Act and other applicable laws.

We will communicate with you through email and notices posted on the BrainCredits website, and through messages or other means available through the service. We may send you a series of emails that help inform new Users about the features of the Service, and we will also send you service messages relating to the functioning of the Service. We may also send you messages with promotional information directly or on behalf of our partners, unless you have opted out of receiving promotional information. You can change your e-mail and contact preferences at any time by logging into your account and changing your settings related to your email notification choices.

How we protect your information

We adopt appropriate data collection, storage and processing practices and security measures to protect against unauthorized access, alteration, disclosure or destruction of your personal information, username, password, transaction information and data stored on the Service. We cannot, however, ensure or warrant the security of any information you transmit to BrainCredits or guarantee that your information on the Service may not be accessed, disclosed, altered, or destroyed by breach of any of our safeguards.

In the event that personal information is compromised as a result of a breach of security, we will promptly notify those persons whose personal information has been compromised, in accordance with the notification procedures set forth in this Privacy Policy, or as otherwise required by applicable law.

Sharing your personal information

We do not sell, trade, or rent Users' personal identification information to others. We may share generic aggregated demographic information not linked to any personal identification information regarding visitors and users with our business partners, trusted affiliates and advertisers for the purposes outlined above. We may use third party service providers to help us operate our business and the Service or administer activities on our behalf, such as sending out emails or surveys. We may share your information with these third parties for those limited purposes, and if we do this, such third parties' use of your information will be bound by this Privacy Policy.

As we develop our business, we may buy or sell assets or business offerings. Customer, email, and visitor information is generally one of the transferred business assets in these types of transactions. We may also transfer or assign such information in the course of corporate divestitures, mergers, or dissolution.

We may share or disclose your information with your consent, such as if you choose to sign on to the Service through a third-party service. We cannot control third parties' use of your information.

We may disclose your personal information if required to do so by law or subpoena or if we believe that it is reasonably necessary to comply with a law, regulation or legal request; to protect the safety of any person; to address fraud, security or technical issues; or to protect BrainCredit's rights or property.

Third party websites

Users may find advertising or other content on the Service that links to the sites and services of our partners, suppliers, advertisers, sponsors, licensors and other third parties. We do not control the content or links that appear on these sites and are not responsible for the practices employed by websites linked to or from the Service. In addition, these sites or services, including their content and links, may be constantly changing. These sites and services may have their own privacy policies and customer service policies. Browsing and interaction on any other website, including websites which have a link to the Service, is subject to that website's own terms and policies.

Compliance with children's online privacy protection act

Protecting the privacy of young children is especially important. BrainCredits does not knowingly collect or solicit personal information from anyone under the age of 13 or knowingly allow such persons to register with the Service. If we become aware that we have collected personal information from a child under age 13 without verification of parental consent, we take steps to remove that information.

Changes to this Privacy Policy

If we change our privacy policies and procedures, we will post those changes on this page to keep you aware of what information we collect, how we use it and under what circumstances we may disclose it. Changes to this Privacy Policy are effective when they are posted on this page. You acknowledge and agree that it is your responsibility to review this Privacy Policy periodically and become aware of modifications.

Your acceptance of these terms

By using the Service, you signify your acceptance of this policy. If you do not agree to this policy, please do not use the Service. Your continued use of the Service following the posting of changes to this policy will be deemed your acceptance of those changes.
